Probate is the legal process of administering a deceased individual’s estate. The probate process includes filing a probate petition, giving notice to creditors/debtors, identifying assets, paying valid claims against the estate, and distributing the assets. Generally, an individual will draft a Last Will and Testament (the “Will”) directing the distribution of his/her estate. A Will may be very simple, leaving one’s estate to a spouse or shared between lineal descendants outright. Or, often in the case of larger estates or mixed families, a Will may employ trusts and advanced estate tax avoidance techniques, such as Qualified Terminable Interest Property Trusts and Qualified Subchapter S Trusts, to preserve and maintain assets. Every Will is required to be filed in the county of the decedent’s residence within a reasonable amount of time following the death.
